Freshora Digital Technologies

Last Updated: 14 April 2025

This Privacy Policy explains how Freshora Digital Technologies (“Freshora,” “we,” “us,” or “our”) collects, uses, stores, shares, and protects personal information when you visit www.freshora.ai, contact our team, request a quotation, subscribe to our updates, or engage us for digital services.

It applies to our website, enquiry and audit forms, email, telephone and WhatsApp communications, proposals, project delivery, support, recruitment, and the other professional services we provide in India and internationally.

We process personal information in line with applicable law, including the Digital Personal Data Protection Act, 2023 (DPDP Act) and the rules made under it, and, where applicable, the EU General Data Protection Regulation (GDPR) and the UK GDPR. By using this website or sharing information with us, you acknowledge the practices described in this policy.

Scope and Who We Are

Freshora Digital Technologies is a digital services company based in Tiruchirappalli (Trichy), Tamil Nadu, India. We provide website development, mobile application development, custom software, digital marketing, SEO, Google Business Profile services, hosting and maintenance, and related technology services.

For the purposes of the DPDP Act, Freshora acts as the Data Fiduciary when it decides why and how personal information is processed for its own business activities, such as enquiries, marketing, invoicing, and recruitment.

When we process personal information on behalf of a client during a project — for example, customer records in a website, application, CRM, or marketing campaign — the client is generally the Data Fiduciary and Freshora acts as a Data Processor, processing information only on the client's documented instructions and under the terms of the relevant agreement.

This policy does not apply to third-party websites, platforms, or applications that we do not control, even where they are linked from our website.

Information You Provide to Us

We collect the information you voluntarily provide when you interact with us. Depending on the nature of your enquiry or engagement, this may include:

  • Identity and contact details: name, company name, designation, email address, telephone or mobile number, city, and country.
  • Enquiry and project information: service requirements, budget range, timelines, project descriptions, existing website or application details, and any documents or files you choose to share.
  • Audit and consultation requests: website URLs, marketing objectives, advertising account details, and the findings or preferences you share with our team.
  • Billing and payment information: billing name, address, GST or tax details, purchase order details, and transaction references. Card, UPI, and net-banking credentials are entered on the payment provider's secure interface and are not stored by Freshora.
  • Communication records: emails, chat and WhatsApp messages, call notes, feedback, and the contents of forms submitted through our website.
  • Newsletter and marketing preferences: your email address, subscription status, and communication choices.
  • Recruitment information: résumés, portfolios, contact details, references, and other information you submit when applying for a role or freelance engagement.
  • Client-supplied materials: content, images, logos, testimonials, and other materials you provide for use in a project, including any personal information contained in them.

Please share only the information that is necessary for your enquiry. We do not intentionally request sensitive personal data such as health records, biometric data, caste or religious details, financial account credentials, or government identification numbers. If you send such information without being asked, we may delete it where it is not required for the service.

Information Collected Automatically

When you visit our website, our hosting infrastructure and the tools enabled on the site may record technical information automatically. This can include:

  • Internet Protocol (IP) address and approximate location derived from it.
  • Browser type, device type, operating system, and screen or language settings.
  • Pages viewed, links clicked, referring pages, search terms that led to the site, and time spent on pages.
  • Date and time of access, server log data, error reports, and security event logs.
  • Cookie identifiers and similar technical identifiers, as explained in the section on cookies.

We use this information to operate and secure the website, understand aggregate usage, diagnose technical problems, measure the effectiveness of our pages and campaigns, and improve the experience for visitors.

We do not use this technical information to identify you individually unless it is necessary for security, fraud prevention, legal compliance, or the investigation of a specific issue.

Information from Third Parties and Public Sources

We may receive information about you from other sources in the ordinary course of business, including:

  • Referrals from existing clients, partners, or professional contacts.
  • Publicly available business information, such as company websites, business directories, and professional networking profiles.
  • Advertising, analytics, and lead-management platforms that report enquiries, campaign performance, or form submissions.
  • Payment gateways, banks, and accounting providers that confirm transaction status and billing details.
  • Recruitment agencies, consultants, and references provided in connection with a job application.

We do not purchase unlawfully sourced contact lists, and we do not knowingly use information obtained in breach of a third party's privacy obligations. Where we combine information from different sources, we apply this policy to the combined record.

Cookies and Similar Technologies

Our website may use cookies, pixels, tags, and local storage to keep the site working correctly and to understand how visitors use it. These technologies fall into the following broad categories:

  • Strictly necessary cookies: required for page navigation, form security, session handling, load balancing, and protection against fraudulent or malicious requests.
  • Preference cookies: remember choices such as language or display settings.
  • Analytics cookies: help us understand page performance, traffic sources, and aggregate visitor behaviour, including through services such as Google Analytics where enabled.
  • Advertising and remarketing cookies: used by platforms such as Google Ads and Meta to measure campaigns and show relevant advertising, where such tools are enabled on the site.

Where applicable law requires consent before non-essential cookies are set, we will request that consent through the notice or preference control made available on the website. You can also block, delete, or restrict cookies through your browser settings.

Disabling strictly necessary cookies may affect the operation of forms, navigation, or other parts of the website. Third-party cookies are governed by the privacy policies of the relevant providers.

How We Use Personal Information

We use personal information for the following business purposes:

  • Responding to enquiries, consultation requests, audit submissions, and quotation requests.
  • Preparing proposals, estimates, and statements of work, and administering client engagements.
  • Delivering, supporting, maintaining, and improving the services we have agreed to provide.
  • Managing invoices, payments, accounting, tax, and statutory records.
  • Sending service updates, project communications, and administrative notices.
  • Sending newsletters, offers, and marketing communications where permitted, with an option to opt out.
  • Measuring website and campaign performance and improving our content, services, and user experience.
  • Protecting our website, systems, and users against fraud, abuse, and security threats.
  • Complying with legal, regulatory, tax, and audit obligations, and responding to lawful requests from authorities.
  • Establishing, exercising, or defending legal claims and resolving disputes.
  • Assessing job applications and managing recruitment or freelance engagements.
  • Showcasing completed work in our portfolio and marketing materials, subject to the confidentiality and promotional terms agreed with the client.

We do not use personal information for purposes that are incompatible with those for which it was collected, unless we have a lawful basis to do so or have obtained the necessary consent.

Lawful Basis and Consent

Under the DPDP Act, we process personal information on the basis of the consent you provide, or another lawful basis recognised by applicable law, such as compliance with a legal obligation or certain legitimate uses permitted by statute.

Where we rely on consent, we aim to present a clear notice explaining the information sought and the purpose of processing. You may withdraw your consent at any time by contacting us using the details in this policy. Withdrawal does not affect processing carried out before the withdrawal, or processing that is otherwise permitted or required by law.

If you are located in the European Economic Area, the United Kingdom, or another jurisdiction with similar requirements, we rely on the following legal bases as applicable: your consent; performance of a contract or steps taken at your request before entering a contract; compliance with a legal obligation; and our legitimate interests in operating and improving our business, provided those interests are not overridden by your rights.

You are not generally required to provide personal information to browse our website. However, certain information is necessary to respond to an enquiry, prepare a proposal, or deliver a service. If you choose not to provide it, we may be unable to proceed with that request.

Marketing Communications and Your Choices

We may send newsletters, service announcements, event invitations, and information about our services to business contacts where we have a lawful basis to do so. Where consent is required, we will ask for it before adding you to a marketing list.

You can opt out of marketing communications at any time by using the unsubscribe link in an email, replying with an opt-out request, or contacting us directly. We will action the request within a reasonable period and in any event within the timeframe required by applicable law.

Opting out of marketing does not prevent us from sending transactional or service-related messages, such as project updates, invoices, support responses, or important notices about an active engagement.

If you contact us through WhatsApp or another messaging platform, your use of that platform is also subject to its own terms and privacy policy. We do not sell or rent personal information to third parties for their own marketing.

Sharing and Disclosure

We do not sell, rent, or trade personal information. We may share it in the following limited circumstances:

  • Within Freshora: with team members and authorised personnel who need the information to respond to your request or deliver a service.
  • Service providers: with hosting, cloud, email, CRM, analytics, advertising, payment, communication, and IT support providers that process information on our behalf.
  • Professional advisers: with lawyers, auditors, accountants, and insurers where necessary for professional advice or compliance.
  • Client engagements: with the relevant client and its authorised representatives when delivering an agreed project.
  • Legal and regulatory authorities: where disclosure is required by law, a court order, a lawful request, or to protect our rights, property, or the safety of others.
  • Business transfers: in connection with a merger, acquisition, restructuring, or sale of assets, subject to appropriate confidentiality protections.
  • With your consent: for any other purpose you specifically approve, including testimonials, case studies, or referrals.

Where we share information with service providers, we take reasonable steps to ensure they are bound by confidentiality and security obligations and process the information only for the purposes for which it was shared.

Service Providers and Third-Party Platforms

We rely on reputable third-party providers for parts of our operations. Depending on the services you use or the engagement, these may include website hosting and content delivery networks, cloud infrastructure, business email, customer relationship management tools, analytics and advertising platforms, payment gateways, SMS and WhatsApp communication providers, project management tools, and security services.

These providers may process personal information in countries other than India. Their handling of information is governed by their own terms and privacy policies, together with the contractual protections we put in place where required.

If you interact with a third-party platform through our website — for example, by clicking a social media link, using an embedded map, or completing a payment — that platform may collect information about you independently. We encourage you to review the privacy information provided by those platforms before sharing personal information with them.

International Transfers

Freshora is based in India, and our primary operations are conducted from India. Some of our service providers, group tools, or clients may be located in other countries, which means personal information may be transferred to, stored in, or accessed from jurisdictions outside your own.

Where personal information is transferred internationally, we take reasonable steps to ensure that it receives an appropriate level of protection. Depending on the circumstances, this may include contractual confidentiality and data protection obligations, provider security commitments, access controls, and encryption in transit.

Where the GDPR or UK GDPR applies, we use appropriate transfer mechanisms recognised under those frameworks, such as standard contractual clauses or transfers to jurisdictions with an adequate level of protection, as applicable.

By using our website or engaging our services, you acknowledge that personal information may be processed outside your country of residence, subject to the safeguards described in this policy and applicable law.

Data Retention

We retain personal information only for as long as it is reasonably necessary for the purpose for which it was collected, or for the period required or permitted by applicable law. Retention periods vary according to the type of information and the context:

  • Enquiries and proposals: generally retained for up to 24 months after the last meaningful contact, unless a client relationship or legal obligation requires a longer period.
  • Client and project records: retained for the duration of the engagement and afterwards for the period required by tax, accounting, contractual, and corporate law, which may be up to eight years or longer where a dispute or legal requirement applies.
  • Marketing records: retained until you unsubscribe or object, plus a limited suppression period to ensure your preference is respected.
  • Recruitment records: generally retained for up to 12 months after the application process ends, unless you agree to a longer retention period or a role remains open.
  • Technical and security logs: retained for a limited period appropriate to security monitoring, incident investigation, and legal requirements.
  • Backups: deleted or overwritten in accordance with our backup cycles, which may mean information remains in backup copies for a short additional period after deletion from live systems.

When information is no longer required, we delete it, anonymise it, or securely dispose of it, subject to any legal hold, dispute, or regulatory obligation that requires continued retention.

Data Security

We maintain reasonable technical and organisational measures designed to protect personal information against unauthorised access, alteration, disclosure, loss, or misuse. These measures include, as appropriate to the nature of the information and the systems involved:

  • Access controls, role-based permissions, and the principle of least privilege.
  • Authentication and account security for internal systems and client platforms.
  • Encryption of data in transit using HTTPS/TLS on our website and supported services.
  • Regular software updates, monitoring, and security reviews of our website and infrastructure.
  • Secure handling of credentials, backups, and project environments.
  • Confidentiality obligations for team members, contractors, and service providers.
  • Procedures for responding to suspected security incidents and reviewing their impact.

No method of transmission over the internet or method of electronic storage is completely secure. While we take privacy and security seriously, we cannot guarantee absolute security. If a personal data breach occurs, we will assess it and notify the relevant authorities and affected individuals where required by applicable law, including the DPDP Act and its rules.

You also have a role in protecting your information. Please use strong, unique passwords for any account or portal we provide, keep credentials confidential, and notify us promptly if you suspect unauthorised access.

Your Rights and Choices

Subject to applicable law and any relevant exceptions, you may have the right to:

  • Request access to the personal information we hold about you.
  • Request correction, completion, or updating of inaccurate or incomplete information.
  • Request erasure of personal information that is no longer necessary or is being processed unlawfully.
  • Withdraw consent you have previously given, without affecting processing carried out before withdrawal.
  • Nominate another person to exercise your rights in the event of death or incapacity, where the DPDP Act provides for nomination.
  • Object to or request restriction of certain processing, where applicable law provides that right.
  • Request portability of information you provided, where applicable law provides that right.
  • Lodge a complaint with a supervisory authority, where applicable.

To exercise a right, please contact us using the details in the final section of this policy. We may ask for information to verify your identity before acting on a request, so that we do not disclose personal information to an unauthorised person.

We will respond within the timeframe required by applicable law. We may decline a request where the law permits or requires us to do so, for example where the information is subject to a legal obligation, a pending dispute, or the rights of another person. Where a request is declined, we will explain the reason to the extent we are permitted to do so.

Client and Project Data

Our clients often entrust us with access to their websites, applications, hosting accounts, advertising accounts, CRM systems, and databases. In those situations, Freshora generally acts as a Data Processor and processes personal information only on the client's documented instructions and for the purposes of the agreed engagement.

The client remains responsible for ensuring that it has a lawful basis to collect and share the information, that appropriate privacy notices are provided to end users, and that any necessary consents or permissions are obtained. A separate data processing agreement can be entered into where required.

Our team members and contractors are bound by confidentiality obligations. Access to client environments is limited to personnel who require it for the project, and we take reasonable steps to protect credentials, test data, and project records.

Where practical, we encourage clients to provide anonymised or synthetic data for testing and development. On completion or termination of an engagement, client data is returned or deleted in accordance with the applicable agreement, subject to legal retention requirements.

Children's Privacy

Our website and services are intended for businesses, professionals, and organisations. They are not directed to children, and we do not knowingly collect personal information from children under the age of 18.

If you are a parent or guardian and believe that a child has provided personal information to us, please contact us so that we can review the matter and delete the information where appropriate.

Where any service could involve information relating to children, we expect the relevant client to obtain verifiable parental consent and to comply with the additional protections required under applicable law, including the DPDP Act.

Third-Party Links and Services

Our website and communications may contain links to third-party websites, social media pages, mapping services, payment platforms, and other resources. Those services operate independently of Freshora and have their own privacy and security practices.

We are not responsible for the content, availability, or privacy practices of third-party websites, and a link does not imply that we endorse their practices. We encourage you to read the privacy policy of any website or platform before providing personal information.

If you access a third-party service using credentials or an account we manage on your behalf, your use of that service remains subject to the provider's terms and privacy policy.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our services, technology, legal requirements, or data practices. The “Last Updated” date at the top of this page indicates when the current version took effect.

Where changes are material, we will take reasonable steps to notify affected individuals, such as by posting a prominent notice on the website or contacting active clients by email where appropriate.

We encourage you to review this page periodically. Your continued use of the website or our services after an updated policy takes effect indicates that you have had the opportunity to review the revised policy.
